Police seek parents charged with second-degree murder of infant encased in concrete

PLEASANT HILL, Mo. – The parents of a newborn discovered inside a blue plastic container encased in concrete, have both been charged second degree murder, although police did not have them in custody on Tuesday and were seeking the public's help to find them.

On Tuesday police did make an arrest, but not one they had intended to make. A neighbor spray painted a strongly worded message on the home where the baby was found.

"Baby Killers not allowed in Pleasant hill, Missouri and not in the US of A" was emblazoned in black spray paint on the home's siding all done in the presence of FOX 4 cameras. And while the man seen doing it was arrested, police are really looking for the couple who lived in the home.

Matthew Scroggs, 28

Matthew Scroggs, 28, and Krystal Scroggs, 29, have been charged on multiple counts of child endangerment, and one count each of felony second degree murder.

In November of 2013, police received reports about a stolen vehicle and possible drug activity inside the couple’s home at 304 Cline St. in Pleasant Hill, Mo. When officers got to the home they arrested Matthew Scroggs in connection to the stolen vehicle that was found outside his house, and was reported to have been stolen out of Kansas City, Mo.

Krystal Scroggs, 29

According to court documents the same source who reported the missing vehicle and drug activity at the couple’s home, had also allegedly stated to police that Matthew had said Krystal was transported to a hospital towards the end of October 2013 due to an infection from possibly giving birth.

When police brought Matthew in for questioning, police say he waived his Miranda rights and admitted to using both marijuana and methamphetamine. After signing a form giving authorities consent to conduct a search of the home, they say he told officers where illegal items and drug related paraphernalia could be found at the residence.

According to a probable cause statement, while inside the Scroggs’ residence, police discovered a blue plastic feed container filled with what appeared to be freshly poured concrete. Officers reported the container was sitting alone in the center of the garage area, which led them to believe the body of a newborn child may be inside.

During a second interview with Matthew Scroggs, police questioned him about the recent pregnancy of his wife, Krystal. Initially he denied she had been pregnant, but later acknowledged she miscarried five months into her pregnancy. When police showed Matthew a photo of the blue plastic container and asked what was inside, he admitted that it was “the baby.” He told police the baby had been delivered stillborn inside one of the bedrooms of his home.

During an interview with Krystal Scroggs while she was still in the hospital, officers said she acknowledged being pregnant but did not seek prenatal care and said she did not want any more children. She said she planned to put the child up for adoption once it was born. Krystal admitted she had used methamphetamine and marijuana throughout the duration of the pregnancy, and said her husband had assisted with the birth.

She said once the baby was born, the baby looked normal, but would not eat. She said she and Matthew had fallen asleep and when they awoke the baby was dead. She said she placed the baby inside a box and said her husband agreed to bury him.

The documents go on to state that following Krystal’s interview with police, Matthew was interviewed once again and asked about the baby. At first he said the baby never took a breath, but after further questioning he stated the baby demonstrated difficulty breathing, and would stop breathing unless his wife bounced or rubbed the baby.

The probable cause states Matthew Scroggs said he had previously researched online that methamphetamine use during pregnancy could cause complications, including breathing difficulties, and stated he expected the baby would suffer complications. It says he acknowledged that neither he nor Krystal attempted to seek any medical attention for the baby.

The Jackson County Medical Examiner’s Office performed an autopsy on the deceased baby. The remains of a male infant were discovered after the concrete was removed from the blue tub. The autopsy revealed the baby had methamphetamine in his system. The cause of death was determined to be methamphetamine intoxication due to the mother’s use of the drug.

Four other children, ages three, four, six, and eleven, were also removed from the home. Matthew and Krystal were charged with five counts each of endangering a child. Methamphetamine was discovered in the systems of all four children as well.

In a press release on Tuesday, police stated that Matthew and Krystal Scroggs are not in custody. They ask anyone with information on the whereabouts of the two defendants to please contact the Pleasant Hill Police Department at (816) 540-9109.

    Pot is harmful. It’s harmful to your lungs. To much pot will make you forget about some things like that. Go to Mexico for a week see what kind of reception the pot growers give you. People in our national forests are growing pot and using rat poison to keep down the varmints. Problem with that is birds and other unintended Animals eat the poison to. Your wright about “someone needing to do some research” Erica because you may be educated but it sounds like you lack common sense.

      Wright? Uh you need some education. Marijuana isn’t without consequence, but wasn’t the reason they encased a baby in concrete. Meth is infinitely more dangerous and likely to cause utter disregard for others when coupled with the obvious mental deficiencies this couple displayed.

        Your right, “Marijuana isn’t without consequences.” So that would make it? Harmful. Marijuana wasn’t what killed the kid but to say it’s harmless is an under statement.

      Seriously, you need an education. WRIGHT isnt how you spell the word needed here. I am a professor at a University, and pot smoke isn’t great for your lungs but it’s not a killer. No one is using rat poison on their plants, or else they would lose customers when you died. Get your facts straight on a public forum dear, because someone more educated than you appear might come along and debunk you! As a smoker for over twenty years, would I still be alive if it killed? Of course not. Go back to school and get off your sofa!

    I’m sorry, Paula, but you thinking it’s “nasty” is in no way scientific evidence of it’s harm. You are trying to lump a god-given plant in with chemicals from under your sink. You know what I think is nasty? A drug that keeps you awake for days if not weeks on end, that makes you pick at yourself, and you want to talk about paranoid? Ha! I guess you’ve never meet a meth user. I would venture to say most of you that have such disillusions about pot were victim to the fear propiganda that made it illegal in the first place. While I’m sorry you fell for the scare tactics that lumped marijuana, again, a plant found growing in nature, in with harmful adulterated drugs I strongly urge you to look into your claims. Norml.org is a great place to start. It is people with your mentality that are causing harmful reprocusiouns for our citizens that could easily benifit from this plant. If you took the time to look past your skewed generalizations of marijuana users you could find out how benificial this plant can be. This couple didn’t do this because the smoke grass. They did it because they are not good people, that in combination with their sleep deprivation from being up for who knows how long, they were literally crazy.

    as interesting as your debate over drugs and wether they are harmful or not, is. I thought this was about the possible murder of a newborn and the whereabouts of the parents that should have been in jail awaiting indictment. Apparently drugs are more harmful than you both thought as you couldn’t even remain focused on the actual thread of the story.

    Your argument is invalid. As, I am a medical student. THC is given to people with terminal illnesses. Along with depression, bi polar, and PTSD as well (in legal states) However, never have we recommended in taking the substance while pregnant. It actually shows, & states that it slows down the productive system for the child.(along with brain signals & that’s why its prescribed to ill people) Which you are told that in a doctors office upon conception. Doctors have information that is scientifically proven. But, im more concerned on a newborn child that was murdered. & had drugs in its system, not debating a marijuana rant.

      At least they removed the other children before they let them go. Hopefully they are with caring, responsible people.
      Not sure why they couldn’t hold them longer. Small town, small police force? Just guessing.

    Marijuana Is absolutely harmless… It takes 1,500 pounds of marijuana consumption within 15 minutes in order to kill a person of THC overdose… You would suffocate from Carbon Monoxide poisoning before you would die of THC overdose… It is LITERALLY impossible to die from smoking Marijuana… the actions of which you do after the fact is on you… if you can’t control yourself after smoking marijuana don’t do it… it should be treated just as alcohol, if you aren’t responsible enough to handle it your not responsible enough to use it… end of discussion… Meth can kill you no matter what age you are infant or a grown person… doesn’t matter meth claims a 5 digit figure if not a 6 digit figure of deaths a year… do your drug research before bashing things such as marijuana and compare them to meth… because its two different things.. Meth is an Amphetemine and is a Psychological Upper where as Marijuana a depressant… two opposite ends of the spectrum people….

    I dont think this is the point. If they want to screw up themselves fine. However, both drugs were found in all the children’s systems. Which means Mom and Dad were giving drugs to the children. Neither Pot or Meth should ever be given to children.

    Okay so I just read this entire thing, plus some of the comments. Are you guys seriously fighting about weed being bad or not? A BABY DIED FROM METH. I love weed and I don’t think it’s harmless but find a different thing to argue on. That little baby and those kids deserve more then teenagers arguing over weed. Grow up.
