Victim says man charged with rape, domestic assault recorded portion of attack on cell phone

GRAIN VALLEY, Mo. -- A 46-year-old man has been charged with four felonies related to a rape and assault that allegedly happened on March 22. James P. Cox of Grain Valley is charged with one count of first-degree rape, two counts of first-degree sodomy and one count of second-degree domestic assault. Police say a portion of the attack was recorded by Cox on a cell phone.

According to a probable cause statement, Cox is accused of raping, strangling and attempting to gouge the eyes out of a woman with whom he is getting a legal separation from at a house they used to live in together.

Court documents say Cox arrived to the home last Saturday night to drop off their child, went inside and refused to leave. He said his name was still on the lease, and he stayed overnight. The next day the victim said Cox became increasingly agitated with her over financial issues during an argument, and she went upstairs to take a shower.

She said Cox followed her upstairs and knocked on a locked bedroom door. The victim said when she cracked the door open, Cox burst through and shoved her backwards onto a bed, pinning her down with his legs and began to strangle her.

The victim said she felt like she was going to die, but Cox would allow her to catch her breath, only to begin strangling her again. She said at one point during the assault, she urinated and defecated herself,  and Cox told her to get into the shower because she was disgusting.

Once in the shower, the victim said Cox forced her to perform multiple sex acts. She said he became upset in the shower and threw her back onto the bed, and again forcibly tried to have sexual intercourse with her.

She said afterwards Cox went to a bedroom closet and pulled out a shotgun, making her to pull the hammer back and pull the trigger and said, "now your fingerprints are on it." She said Cox told her that she was going to kill a family member of hers in the house, and one other person that she needed to pick. Then Cox told her to call 911 so that he could go outside and meet police with a shotgun so they would shoot him. No gunshot injuries were reported in this incident.

When the victim did call 911, she hung up on her initial call. When a dispatcher called back, the victim stated everything was alright, but a dispatcher sensed things were amiss, and sent officers to the home.

Police interviewed the victim and saw two small cuts near her tear ducts, several marks all around her neck, and other marks on her arms and chest. The victim told police the cuts were the result of Cox attempting to gouge her eyes out with his thumbs.

The victim was also able to provide police with a video that Cox had taken during a portion of the assault on a cell phone. Police say the video shows Cox holding the victim down on the bed, and the victim begging Cox to get off of her because she couldn't breathe.

Cox is being transferred to the Jackson County Detention Center and will be held on a $250,000 cash-only bond. Online records don't list any court dates for him yet.
