“Botched Burial” Lawsuit

OVERLAND PARK, Kan. -- An Overland Park family laid a loved one to rest in May of 2010, or so they thought.

There were so many problems, they ended up burying him twice. The family hired an attorney and filed a lawsuit. Attorney Brian Niceswanger says the funeral and graveside service at Oak Lawn Memorial Gardens went as planned, but after the family left, getting the vault and casket into the ground was anything but smooth.

Niceswanger says the workman at the cemetery tried to put the casket in but there was too much water and it floated. The casket was supposed to be waterproof, but it filled with water. When workers removed the casket, they drilled holes in the side to drain the water. Everything had to be replaced and re-done.

"You have a nice service with military honors 21 gun salute, fiend and family from area are in, nice memorial to the deceased, and then you have to re-do it five days later, and you have same guys digging the hole, being the pall bearers, it's one of saddest things I've ever seen," Niceswanger said.

There was no comment or response from the companies being sued.

The family says it's not about the money, it's about saving another family from going through what they had to.
