Son Sues Fruit Company Over Father’s Death

KANSAS CITY, Mo. — The son of Paul Schwarz, a 92-year old Kansas City man, who died after eating cantaloupe tainted with the Listeria bacteria, is suing the Colorado cantaloupe farm for wrongful death.

According to the Kansas City Star, attorneys amended the damage lawsuit against Jensen Farms into a wrongful death lawsuit when Schwarz died in December.  Federal health investigators linked the Listeria outbreak to unclean machinery that processed the cantaloupe at Jensen Farms.

There were 146 cases nationwide.
