Couple loses deposit money on unrentable home

BLUE SPRINGS, Mo. -- A metro-area couple was fighting Friday to get their money back after they say a woman took a deposit from them on a home she didn't own or have authority to rent.

Danielle and Mike Niccoli were preparing to move into the home on Sunday, along with their five children, after finding the four-bedroom Blue Springs house on Craigs List.  In early August, they went to see the house on Northeast Quailwalk Drive. Liking what they saw, they filled out an application and gave Amanda Paris a check for $1,250.

They say they tried to get ahold of Paris to meet them, but by Thursday, when they still hadn't signed a lease, they texted her and asked if they could start moving in without signing it. Danielle said Paris texted them back to tell them she was in Omaha because her daughter was in intensive care, battling leukemia.

The Niccolis said Paris never texted them back when they asked her if she would email the lease.

Jamie Stidham is the actual owner of the house, and told FOX 4 that it is not up for rent.

"I've texted her a couple of times trying to get in touch with her and have yet to hear from her," said Stidham, about Paris. "She's not allowed to sublease my home," said Stidham.

FOX 4 was there when Amanda Paris drove into her driveway.  Speaking to her through the front door, Paris admitted she cashed and spent the Niccolis' $1250.
"It was used for payments," she told FOX 4's Robert Townsend. "I was going to move."

Meanwhile, Mike and Danielle Niccoli say they are about to be homeless with five children.

"We have no more deposit money and we have nowhere to move. We have to be out of our place by October 1st," said Danielle Niccoli.

"I mean, what do we do? I mean you took the last of our money," Mike Niccoli said.
