I was just talking to my kids about this. Drivers need to remember that the pedestrian always has the right of way in a crosswalk. Statute 8-1535 “Notwithstanding other provisions of this article or the provisions of any local ordinance, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused or incapacitated person.” Straight from the KDOT.

Notwithstanding other provisions in this article….(read the whole thing)…

Sec. 64. Pedestrians’ Right-of-Way in Crosswalks; Control Signals.

      (a) When traffic-control signals are not in place or not in operation the driver of a vehicle shall yield the right-of-way, slowing down or stopping if need be to so yield, to a pedestrian entering or crossing the roadway within a crosswalk.

      (b) No pedestrian shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close as to constitute an immediate hazard.

Sec. 65. Crossing at Other Than Crosswalks; Jaywalking.

      (a) Every pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway.

How could the man not see a car coming? I think it would be his responsibility to watch out for cars. He isn’t a little kid. Besides, why do these joggers run on busy streets? Can’t they find a quiet area to run around? Maybe he was showing off his short shorts which too many old men seem to prefer.
