KANSAS CITY, Mo. — A man suspected of threatening an officer with a screwdriver in the River Market on Friday night, leading to the officer shooting him, faces weapons and assault charges. Jackson County prosecutors charged James Brisbin, 26, with aggravated assault on a law enforcement officer and armed criminal action on Monday.

Court documents say officers responded to the 400 block of Grand on reports of a man hitting a woman. When police arrived, a probable cause statement says that Brisbin reached into a backpack and pulled out a screwdriver. Police say he refused to drop it and moved toward officers in a threatening manner. When the officer retreated, Brisbin kept walking towards the officer, leading to shots being fired.
An eyewitness shared what he saw with FOX 4 on Friday night.
“The officer has somebody held at gunpoint, giving him commands, and you can kind of hear there is an argument going on between them. It looks like maybe he might have moved or done something wrong and the officer shot him. He was definitely at fault and not complying with orders,” Perry Jordan said.
“You could hear him saying ‘I can’t move! I can’t move!’ We just kind of sat there for a second and were like, ‘did this really happen?’ We weren’t sure if it was a taser that was making the noise, but we saw the muzzle flash and we were like, ‘he definitely got shot,'” Jordan continued.
The officer wasn’t injured. Court records show Brisbin is a convicted felon, having pled guilty to burglary and assault charges in Jackson County, in addition to an assault charge in Callaway County.
Brisbin remains hospitalized, when he’s booked into jail he’ll be held on a $50,000 bond. No court dates have been set yet.
